Terms of Service

Welcome to beermap. These Terms of Service ("Terms") govern your use of the beermap web application, mobile app, and related services (collectively, the "Service") available at beermap.be. By accessing or using the Service, you agree to be bound by these Terms.

1. Acceptance of Terms

By creating an account or using the Service, you confirm that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you do not agree, do not use the Service.

2. Eligibility

You must be at least 16 years old (or the minimum legal drinking age in your jurisdiction, whichever is higher) to use the Service. By using the Service, you represent and warrant that you meet this age requirement.

3. Account Registration

• You must provide accurate and complete information when creating an account
• You are responsible for maintaining the confidentiality of your password
• You are responsible for all activity that occurs under your account
• You must notify us immediately of any unauthorized use of your account
• You may register with an email address or via Google Sign-In

4. User Content

4.1 Your Content

You retain ownership of all content you create on the Service, including beer pins, photos, videos, ratings, and comments ("User Content"). By posting User Content, you grant us a non-exclusive, worldwide, royalty-free license to use, display, reproduce, and distribute your User Content solely for the purpose of operating and improving the Service.

4.2 Content Responsibility

You are solely responsible for your User Content. You agree not to post content that:

• Is illegal, harmful, threatening, abusive, harassing, defamatory, or otherwise objectionable
• Infringes on any third party's intellectual property rights
• Contains viruses, malware, or other harmful code
• Promotes excessive or dangerous alcohol consumption
• Impersonates another person or entity
• Contains spam, unsolicited advertising, or commercial solicitations

4.3 Content Visibility

You control who sees your beer pins through visibility settings:

• Public: Visible to all users and may appear in search engines
• Friends: Visible only to your approved friends
• Private: Visible only to you

5. Acceptable Use

You agree to use the Service responsibly and in compliance with all applicable laws. Specifically, you agree to:

• Drink responsibly and legally
• Never use the Service while operating a vehicle or machinery
• Not attempt to access other users' accounts or data
• Not use the Service to harass, stalk, or threaten others
• Not collect other users' personal information without their consent
• Not use automated tools (bots, scrapers) to access the Service
• Not circumvent any security features or rate limits
• Not use the Service for any commercial purpose without our written consent

6. Friends and Social Features

• You can send and accept friend requests to connect with other users
• Friends can see your beer pins based on their visibility settings
• You can remove friends at any time
• You are responsible for managing your friend connections
• We are not responsible for the actions of other users

7. Intellectual Property

The Service, including its design, code, logos, and branding, is the intellectual property of beermap and is protected by copyright and other intellectual property laws. You may not copy, modify, distribute, sell, or lease any part of our Service without our written permission.

8. Media Uploads

When you upload photos or videos:

• You confirm you have the right to upload such content
• You grant us the license described in Section 4.1 to store and display your uploads
• You may delete your uploads at any time by deleting the associated pin
• We may compress or resize images for storage efficiency

9. Advertising and Purchases

The Service is currently free to use. We reserve the right to introduce premium features, subscriptions, or advertising in the future. Any such changes will be communicated in advance and will not retroactively affect existing content.

10. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT:

• The Service will be uninterrupted, timely, secure, or error-free
• The results obtained from the Service will be accurate or reliable
• The Service will meet your specific requirements

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, BEERMAP SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM:

• Your use of or inability to use the Service
• Any unauthorized access to or use of our servers and/or personal information
• Any interruption or cessation of the Service
• Any bugs, viruses, or other harmful code that may be transmitted through the Service
• Any conduct of any third party on the Service

12. Indemnification

You agree to indemnify, defend, and hold harmless beermap and its operators from any claims, losses, damages, liabilities, costs, and expenses (including reasonable attorneys' fees) arising from:

• Your use of the Service
• Your violation of these Terms
• Your violation of any rights of another party
• Your User Content

13. Account Deletion

You may delete your account at any time through the app's settings. Account deletion is irreversible and will permanently remove:

• Your profile and credentials
• All beer pins, photos, and videos
• All friend connections, comments, and likes

Processing may take up to 30 days.

14. Content Reporting

We comply with the EU Digital Services Act (DSA). If you encounter content that you believe is illegal or violates these Terms, you can report it by emailing support@beermap.be with a description of the content and its location. We will review reports promptly and take appropriate action.

15. Termination

We reserve the right to suspend or terminate your account at our discretion, with or without notice, for conduct that violates these Terms or is otherwise harmful to other users, the Service, or third parties.

16. Changes to These Terms

We may revise these Terms at any time. We will notify you of material changes by posting a notice on the Service or sending you an email. Your continued use of the Service after changes are posted constitutes your acceptance of the revised Terms.

17. Governing Law

These Terms are governed by the laws of Belgium. Any disputes arising from or relating to these Terms or the Service shall be subject to the exclusive jurisdiction of the courts of Belgium.

18. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.
